Berger, Justice: In this appeal, we consider whether a criminal defendant who decides not to testify may seek review of a trial court's ruling on the admissibility of impeachment evidence. Franklin Fennell, who was being tried on three drug charges, moved to exclude evidence of his prior drug conviction. The trial court denied his motion and, as a result, Fennell decided not to testify. Fennell now challenges the trial court's evidentiary ruling, among other issues raised on appeal.
